ENCORE MEDICAL WARRANTY
Encore Medical Technologies, Inc. (Encore) warrants to the original purchaser that its products shall be free from defects in material and workmanship for a period of twelve (12) months after date of delivery. Encore’s obligation under this warranty is expressly limited to supplying replacement parts for, or replacing, at its option, any product that is, in the sole discretion of Encore, found to be defective.
This warranty does not cover failure due to negligence, accident, deliberate abuse and/or installation not in accordance with the provided instructions, or failure to follow maintenance instructions.
Encore makes no warranties that extend beyond the description on the face hereof. Encore’s obligation under these warranties shall not include any liability for direct, indirect, or consequential damages or delays.
If requested by Encore, products or parts for which a warranty is made shall be returned prepaid to Encore’s factory. Any improper use or any alteration or repair by others in such a matter as in Encore’s judgment affects the product materially and adversely shall void this warranty.
No employee or representative is authorized to change this warranty in any way or grant any other warranty.
